A. The US$1,000 Giveaway will be awarded to a participant who has submitted a legitimate profile photo that has been randomly selected for print on one of the first 1,000 One Face One Race Products. The participant must be at least 18 years old at the time of photo submission. All employees of One Face One Race, Emerald Ideas and all their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. All applicable federal, state and local laws and regulations apply. Void in any country or state where such draws are prohibited or restricted.

B. The US$1,000 Giveaway will be awarded to the person whose face featured on one of the 1000 products sold.  You must be the person in the photo and it must have been submitted by you. The winner will be required to verify their identity with official photographic ID. Passport, driving license and national ID will be accepted.

2. DRAW PERIOD: The draw will not take place until the sale of our 1,000th One Face One Race product form the www.onefaceonerace.com website. All profile photos featuring on the first 1000 products sold will appear in the One Face One Race Facebook Photo Album. No purchase is necessary to be in the draw for the US$1000 Cash giveaway as it if free to submit your photo.

3. PHOTO SUBMISSION:

Image Submission Phase: During the Promotion, visit Onefaceonerace.com an upload your Profile Photo by clicking on the 'Submit your Photo' tab.

Photograph Requirements:

Submissions strictly limited to one profile photo per person.

Must adhere to all listed Technical Specifications set forth below.

Must be the participant's original photograph.

Must not infringe on or violate any other person's or entity's rights, including any rights of privacy or publicity.

Must comply with the onefaceonerace.com's Terms of Service located at www.onefaceonerace.com/terms.php.

Follow the links and instructions to upload your photograph. Any submission that includes content that is deemed inappropriate, indecent, and obscene or otherwise does not comply with the Content Restrictions set forth below, as determined by onefaceonerace.com in its sole discretion, shall not be eligible. 

Content Restrictions: The photograph must NOT contain:

Nudity, lewd or vulgar behavior.

Material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, including but not limited to copyright infringement.

Brand names or trademarks.

Photos of artwork without proper license or ownership.

Material that is hateful, tortuous, defamatory, slanderous or libelous.

Material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

Material that is unlawful, in violation of, or contrary to the laws or regulations in any country where the Photograph is created.

Failure of any photograph to comply with the above restrictions, as determined by onefaceonerace.com in its sole discretion, shall result in disqualification.

Technical Specifications: Participant must upload files of the photograph that comply with the following specifications:

File size: under 3 MB

Formats: JPG, GIF, PNG.

Failure of any submission to comply with the above specifications, as determined by onefaceonerace.com in its sole discretion, shall result in disqualification.

All photos submitted are subject to the terms and conditions set out in our Photo Waiver which you much agree to before uploading a photo.

We will periodically upload the randomly selected profile photos on products sold to our Facebook page. To receive updates of these upload just go to the One Face One Race Facebook page and click ‘like'.

License:  However, by entering a photograph to appear on a One Face One Race product, the participant grants One Face One Race the non-exclusive irrevocable, perpetual right to edit, adapt, use and publish in any media now known or hereafter discovered any or all of the photographs without compensation to the participant, his or her successors or assigns, or any other entity. ENTERING A SUBMISSION IN THIS CONTEST CONSTITUTES PARTICIPANT'S IRREVOCABLE ASSIGNMENT, CONVEYANCE, AND TRANSFERENCE TO onefaceonerace.com OF THE FOREGOING RIGHTS. 

4. THE DRAW:

The winner will be drawn from the randomly selected profile photos that were printed on the first 1000 One Face One Race products sold. The profile photos featured on the first 1,000 products sold will be uploaded to the One Face One Race Facebook photo albums. The draw will take place within 7 days of the 1000^th product sold.

5. REQUIREMENTS OF DRAW WINNERS: The winners shall be notified by email within 7 days of the draw. In the event of a dispute as to the identity of a participant, the authorized account holder of the email address used to submit the chosen photograph shall be deemed to be the participant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The winner may be required to show proof of being the authorized account holder. The Winner must comply with all draw rules as published. The potential prize winner shall be required to sign and return an Affidavit of Eligibility and Liability and Publicity Release within five (14) days from the date of notification. In the event that any potential winner is disqualified for any reason, the prize may be awarded to another participant as determined by onefaceonerace.com. The Winners agrees to conduct any and all media interviews related to the Giveaway if requested and not disparage Onefaceonerace.com during any such interviews. Failure to comply with this requirement for any reason or return of prize notification or prize as undeliverable shall result in forfeiture of any prize, and the prize may be awarded to the next participant as determined by the panel of judges. Acceptance of prize shall constitute and signify the winner's agreement and consent that onefaceonerace.com may use the winner's name, address (city, state), likeness, Photograph, and/or prize information for contextual purposes worldwide, including the internet, without limitation and without further payment or consideration, except where prohibited by law. Winner agrees to modify photograph in any way dictated by onefaceonerace.com Winner must supply all necessary files in a format that complies with the Technical Specifications.

6. PRIZES: The Winner will receive a cheque in the amount of US$1,000 or the equivalent in your National currency at the date of the draw. We will use www.ex.com to determine the currency rate on that date.  Winning photograph shall be displayed on the Onefaceonerace.com and our Facebook page.  Date of publication to be determined by onefaceonerace.com. The cheque will be posted to the winner within 21 days of the draw.

7. DISCLAIMER AND INDEMNIFICATION: Submitting a photo does not guarantee your photo will be randomly selected for print on one of the first 1,000 products sold. By submitting a photo, participants agree to be bound by these Official Rules. Onefaceonerace.com assumes no responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any submission or other information, or for the failure to capture any such information. onefaceonerace.com is not responsible for: (1) any incorrect or inaccurate information, whether caused by participants, or by any of the equipment or programming associated with or utilized in the draw; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the submission process or the draw; or (4) technical or human error which may occur in the administration of the Contest or the processing of entries. Further, if, for any reason, the draw is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of the omefaceonerace.com, may corrupt or affect the administration, security, fairness, integrity or proper conduct of this draw, onefaceonerace.com reserves the right, at their sole discretion, to cancel, terminate, modify or suspend the draw, and select the winner for the draw, from the entries received prior to the action taken or in other such manner as deemed fair and appropriate by onefaceonerace.com.

Participants, by submitting a photo, hereby waive and release, and agree to defend, indemnify and hold harmless, Onefaceonerace.com,  and their respective parents, subsidiaries, affiliates, distributors, and all of their respective officers, directors, employees, representatives and agents, and their respective successors and assigns (the "Indemnified Parties"), from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from: their acceptance, possession, use or misuse of the prize in the draw; or their participation; or the use of the photograph, including without limitation any claims relating to violations of the Content Restrictions. Winner also further acknowledges that the Indemnified Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law relative to any prize or this draw including but not limited to quality, condition or fitness for a particular purpose.

8. PERSONAL INFORMATION: The personal information collected through the draw is subject to the onefaceonerace.com Privacy Policy at http://www.onefaceonerace.com/privacy.php.

9. RULES/WINNER LIST REQUESTS: The winner will be announced on the One Face One Race Facebook fan page and also in our website News section on www.onefaceonerace.com/new.php

11. LAW AND VENUE: Except where prohibited, participant agrees that any and all disputes, claims and causes of action arising out of or connected with this draw or any prize awarded shall be resolved under the laws of the Republic of Ireland, without respect to any conflict of law issues, and participant agrees that such shall be resolved individually, without resort to any form of class action, and exclusively by the State Courts located in Dublin, Republic of Ireland.
